The DA's case against PL is getting slammed before it reaches court

AT ONE POINT DURING LAST WEEK'S STORMY of the Humboldt County Board of Supervisors, County Counsel Tamara Falor tried to get the five supervisors back on point.

The focus here, she said, should be on the liability that might arise should the board approve District Attorney Paul Gallegos' request to bring in a San Francisco Bay Area firm to help in his lawsuit against the Pacific Lumber Co.

The reminder fell largely on deaf ears. Roger Rodoni had set the tone early on when he wondered whether the lead lawyer for the firm, Joe Cotchett, would want a park named after him after he put Pacific Lumber out of business. Bonnie Neely said flatly, almost impatiently, that she had serious doubts about the merits of Gallegos' case -- a sentiment that was echoed later on by Jimmy Smith. Throughout, the newest supervisor, Jill Geist, had a lot of questions, not all of them terribly relevant.

Only John Woolley seemed to recognize the obvious: that the emotional, overheated atmosphere that prevailed that day in the Supervisors' chambers -- packed as it was with agitated loggers and a much smaller number of environmentalists -- was not an ideal atmosphere in which to make a decision. The board, Woolley suggested, needed more time to chew on the proposal. He made a motion to reconsider it at the next meeting, March 25. It died for lack of a second.

Neely's motion to deny Gallegos' request, already on the table, was then voted on. It passed on a 4-1 vote, with Woolley the odd man out.

So ended one of the more contentious, and perhaps fateful, supervisors' meetings in memory. The upshot was that Gallegos and Assistant District Attorney Tim Stoen, the lawyer in charge of the case, are on their own. While Pacific Lumber has large legal resources at its disposal, the DA will have to rely on his own staff and whatever resources he can bring to bear with his $2.7 million budget.

As is well known by now, the DA is accusing Pacific Lumber of concealing critical information during the 1999 Headwaters negotiations. They say the deception enabled the company to log as many as 100,000 redwoods on unstable slopes that it otherwise wouldn't have been able to get at. They are seeking as much as $250 million in damages.

Gallegos and Stoen could come back before the Supervisors and try again to win their approval to enter into a contractual agreement with the Cotchett firm. But barring some unforeseen development that would enhance the case before it goes before a judge, there doesn't seem to be much point. Geist, perhaps, might vote differently, but Smith, Rodoni and Neely clearly have their minds made up.

While Gallegos and Stoen put a brave face on things last week, vowing to push ahead, the fact of the matter is that they lost the services of a firm that has extensive expertise in precisely the field of law they are litigating in the PL case: corporate fraud.

Referring to a high-profile savings and loan case in which Cotchett won a $1.7 billion settlement, Stoen said, not without a trace of bitterness: "That's the kind of legal talent turned down by the board."

An influential letter

To a large extent, Gallegos and Stoen were done in by a letter from the California Department of Fish and Game.

Addressed to Stoen, it arrived in the DA's office on March 10, the day before the supervisors' meeting. So late did it arrive that Stoen didn't even see it until the next morning, when he was about to go before the board. The supervisors also received copies.

When Stoen read it, and saw the assertion that "there are errors in the facts presented" in the DA's case, it didn't make his day, to put it mildly. "I felt blindsided," he said later.

The letter was a major reason the supervisors voted not to engage the services of Cotchett's firm -- despite the fact that the letter said nothing about the issue before the board, the hiring of outside counsel.

"In terms of hiring outside counsel, that's not our business," said Fish and Game Conservation Program Manager Mark Stopher, speaking from his Redding office a couple of days after the meeting. "We're not in a position to decide if the DA needs help or not."

Supervisor Smith said that in discussions with Fish and Game Regional Manager Don Koch and CDF Director Andrea Tuttle the weekend before the meeting, and through reading material forwarded by their attorneys, he had come to the conclusion that the county would be put at significant risk if the Cotchett firm was hired.

"[The California Departments of Forestry, and Fish and Game] said they were going to step up to the plate [to defend PL]," Smith said in an interview last Thursday. "I don't think it was ever perfectly clear what the cost could be to the county to take on the state and federal government, henceforth my vote was no."

It may sound like Smith was second guessing the DA on the merits of bringing a fraud case against PL. Not so, Smith said.

"If the DA chooses, and I believe him to be a man of good character, he can make that choice: that's his domain. I would never, ever second guess him on that."

Why did Fish and Game comment on pending litigation (in which its representatives might be called to testify) in the first place?

Stephanie Tom Coupe, senior staff counsel with Fish and Game and the author of the letter to Stoen, said the department wanted to make sure he knew that Fish and Game was already defending the Headwaters deal in a legal challenge brought by the Environmental Protection Information Center, a Garberville group that has long been a thorn in PL's side.

"We wanted him to understand that," Coupe said in a telephone interview from her Sacramento office. "We tried to communicate that we wanted to avoid a situation in which we would be testifying against Humboldt County."

According to Stopher, the department sent the letter because Stoen wasn't listening to reason in their first and only meeting on March 7, the Friday before the supervisors' meeting.

"We (Fish and Game) came away from that not sure whether or not they were interested in hearing what we had to say," Stopher said. "I thought maybe Mr. Stoen was already vested [in the case] and wouldn't adequately consider our comments if they were only put verbally."

A Fish and Game source said Stoen became hostile when factual errors in his 45-page legal complaint were spelled out at the meeting.

Two subsequent conference calls on the 13th and 18th were called off by the DA's office without any reason given.

"My sense is that he considers us now to be the enemy," Stopher said.

The target was Reid

The factual information recounted in the letter doesn't go to the heart of the case, alleged fraud committed by PL. But it does attack some important peripheral points.

The suit alleges that PL concealed information contained in a report on the Jordan Creek watershed, located above Humboldt Redwoods State Park, and as a result successfully persuaded then CDF Director Richard Wilson to approve a less stringent set of logging restrictions known as "Alternative 25."

That alternative, as well as the one Wilson originally chose, "Alternative 25a," are part of a key document in the Headwaters deal, the Sustained Yield Plan, which imposes limits on PL's logging rates over the next 100 years.

Coupe's letter stated that "The CDF director's decision to approve Alternative 25 did not provide additional access for PL to harvest timber on unstable areas. It did provide the ability to harvest additional timber from portions of the ownership which are not unstable."

If that's true, it cuts Gallegos' case off at the knees because he's alleging that PL's deception enabled it to access timber in areas prone to sliding.

But Coupe's statement conflicts with one contained in a letter signed by two high-ranking officials of the U.S. Fish and Wildlife Service and the National Marine Fisheries Service. Dated Feb. 27, 1999, right at the time when Wilson was being pressured to approve Alternative 25, the letter said the following: "According to information received from PL, most of the difference in available harvest volume in the two alternatives is derived from the amount which can be harvested in mass wasting areas of concern." In other words, unstable areas.

Alternative 25, it turns out, does indeed allow for selective logging on unstable slopes if a geologist can figure out a way to make it work without producing undue amounts of sediment. Alternative 25a prohibits logging on unstable slopes, plain and simple.

So the DA's complaint has merit?

That would seem logical, were it not for another Headwaters document, the Habitat Conservation Plan -- designed to protect endangered species -- which trumps the Sustained Yield Plan. The HCP does not allow harvesting on slopes that have more than a high risk of producing excess sediment.

So the DA's case doesn't have merit?

That, too, would seem logical were it not for another possibility: the HCP itself is flawed. According to Ken Miller, a vehement PL critic, there is disagreement to this day, even with the restrictions imposed by the HCP, about what constitutes a stable area and what constitutes an unstable area. That uncertainty might have been avoided had the work of Leslie Reid, a leading expert on the cumulative impacts of logging, carried more weight. Reid, of the U.S. Forest Service's Redwood Sciences Laboratory in Arcata, studied the Bear Creek watershed immediately adjacent to the Jordan Creek basin in the late 1990s. She ended up recommending a methodology to determine sustainable logging levels that Pacific Lumber blanched at because it was too restrictive. It was to prevent Reid's "methodology" from being generalized to Jordan Creek and the rest of the 211,000 acres under PL ownership that PL carried out its deception.

That, at least, is what Stoen says in his complaint.

Public input thwarted

Stoen, for his part, essentially called the Fish and Game letter a red herring.

"Frankly, it doesn't address the fundamental issue," Stoen said.

Which is, he said, the apparent fact that when Wilson ditched Alternative 25a in favor of Alternative 25, he did so not knowing that Pacific Lumber had, at the eleventh hour, given correct data on Jordan Creek to a mid-level CDF official in Fortuna. Had Wilson known that, he would have recirculated a document called the Environmental Impact Report to various state and federal agencies and to the public for input. That input, in turn, could have led to stricter logging restrictions. But he didn't know about the new data (the official in Fortuna, according to Stoen's complaint, never passed it up the chain of command) and as a result, the report was never recirculated.

Therefore, according to Stoen, the report, which the Headwaters deal hinged on, was fraudulent.

"If the EIR was fraudulent, then there's no right to cut any trees," Stoen said.

Stoen said he was angry that Fish and Game chose to release its letter just before last week's supervisors meeting. And he doesn't think that was an accident.

"It was a clever ploy to get the supervisors nervous," he said.

Tree-sitters taken down

PACIFIC LUMBER CO. MADE GOOD ON ITS PROMISE TO TAKE DOWN TREE-SITTERS FROM their perches in Freshwater this week, launching an operation that's supposed to last several days.

On Monday long time tree-sitter Remedy and her neighbor Wren were hauled down in a day-long operation, involving six climbers, more than 15 Humboldt County Sheriffs (many working on their day off), seven correctional staff from the Humboldt County Jail to book prisoners, at least four California Highway Patrol officers and tens of activists.

Greenwood Heights Road, an offshoot of Kneeland Road that winds up a wooded mountainside just northeast of Eureka, was blocked off by Pacific Lumber personnel for several hours on Monday. The company's justification for the closure, which involved no public notification? An encroachment permit it had applied for last year.

The aim was apparently to prevent activists from gathering at the base of trees that tree-sitters occupied. But even residents were turned back. Only press, PL workers and law enforcement were allowed.

Humboldt County Supervisor John Woolley received about 30 angry calls from his constituents and looked into the matter. After consulting with Public Works (which manages county roads) Woolley concluded that the encroachment, which was solely for logging, didn't apply to tree-sitter extraction, and county attorneys notified PL that the barricades would have to come down.

"It's only there for commercial logging processes," Woolley said, adding that he was worried about lawsuits. "You could see the future, if you're dealing with an illegal encroachment permit."

County Counsel Tamara Falor said PL must give Public Works two-week notice of any road closure. Such notice was not given in this case, Falor said.

Sheriff's deputies, unaware of the wrangling behind the scene, went to work early enforcing the permit. They walked a group of activists that had gathered at the base of the tree down the road, until one of the more vocal ones, Alexander Carpenter, aka Four Winds, 26, laid down in the road and was arrested.

"I got so tired of being pushed down the hill by billy clubs I laid down and let them arrest me," Carpenter said. "I was a guilty man there."

Carpenter was back on the scene as soon as he got out of jail.

The climbers, led by the always cheerful Eric Schatz of Schatz Tree Service, threw ropes into the trees and went up after the tree-sitters, three climbers per tree. Hours passed and nothing happened. A cold wind blew.

After four o'clock the road was opened and activists began to stream back. They were herded past the tree-sits, contained by a wall of deputies.

Around 5 p.m., after hours of apparently pleasant, if fruitless, coaxing by Schatz, Remedy was brought down; they had cut the chains that anchored her in her lock box.

"If the chains had been shorter they wouldn't have been able to do that. It was kind of a faux pas on my part," Remedy said in an interview Tuesday.

The mood was emotional. People were crying. When Remedy appeared and was driven away in a cop car the crowd surged forward, blocking the road. Deputies forced them back. Finally they sat down on the road and chanted.

When Wren came down things got ugly. Activists were shoved back by batons and the crowd was pepper-sprayed. Several people were arrested.

That night, both trees were reoccupied, Remedy's by three women and Wren's as well. In the case of Wren's tree, activists reportedly climbed up PL's own rope, which had been left overnight.

The next day the climbers came to the heavily populated lower village but were only successful in removing one tree-sitter, Annapurna. She was unhurt. Her tree was immediately reoccupied by tree-sitters travelling high up on traverse lines.

In an apparent gesture of frustration at the end of the day, PL employees surrounded the tree, still occupied, and girdled it with a chainsaw, removing the bark from around the base of the tree to kill it.

Activists on the road rushed the workers screaming that the tree was occupied, almost as if in pain. Some scrambled to protect surrounding trees but the workers didn't do anything more.

After two days, three tree-sitters had been arrested, three trees reoccupied, one road reopened, one tree girdled, 11 ground-based activists arrested. Stay tuned. The battle is supposed to continue all week.

Stymied in his attempt to hire an outside law firm for his suit against the Pacific Lumber Co., District Attorney Paul Gallegos may get a bit of help from local residents.

A Redway man has started a fund to help defray the county's legal expenses in connection with the lawsuit. Jared Rossman, a landlord and property manager, sent out an e-mail urging people to "put your money where your mouth is" and donate to his "Citizens' Fund for Equal Justice."

"I was so upset by the way the Board of Supervisors handled this," he said. They could have shown support for "this independent DA." Instead, they missed an opportunity. "If the county officials are going to drop the ball then the citizens are going to have to pick it up," he said. "When the law is applied evenhandedly, the truth will win out, and that's what America was built on."

The fund was established at the Community Credit Union of Southern Humboldt in Garberville. It was unclear at press time whether it is legal for a citizens' group to earmark private donations for use by the county in a specific lawsuit.

Meanwhile, another local man has started a group called the Alliance for Ethical Business, a "citizens advocacy group concerned about corporate crime," said founder Richard Salzman. He said his group would support Gallegos' efforts to discover the truth in the Pacific Lumber case, and is organizing an event for April 9 at the Arcata Community Center in which Gallegos and Assistant DA Tim Stoen will answer questions about the lawsuit.

NOTE: Gallegos' lawsuit never made it past demurrer, though he appealed it all the way to the California Supreme Court, where he was laughed out of the room, and they denied his appeal.

The suit was a case of activists succeeding in getting an elected official they had backed to publicly file their private lawsuit, a public prosecution. But they were armed only with bumper sticker rhetoric and a layman's understanding of the issue, activist pipe dreams, as it were.

Their attempts to bring in their big gun, Bob Cotchett, were thwarted, when the Board of Supervisors refused to allocate the funds to pay his high fees. The activists concocted all kinds of scenarios where the fines per tree would pay for the lawyer, and even devised a "Trust Fund' scheme, in which they plotted to solicit, accept and use special interest money to privately fund a public prosecution.

They failed. And failed, and failed again. It seems in the end, Mr. Easthouse should eat his words.

The media also failed in this entire debacle. Many reporters followed Gallegos around with their tongues hanging out, and their glowing, loving reports must embarrass them in hindsight.

It's time for the record to be corrected.

Judge Bruce Watson denied a motion to dismiss a burglary case Friday, amid accusations by a public defender that a former Humboldt County District Attorney's Office prosecutor committed misconduct by failing to report a police interview with his defendant, saying it was not warranted under the circumstances.

The district attorney's office had argued the non-disclosure was simply negligence, resulting from an over-burdened staff.

The case highlights the sometimes controversial practice of police officers attempting to gain information from inmates in exchange for leniency in sentencing.

A mistrial was declared in the case on Dec. 13, following opening statements. Judge Marilyn Miles, who was overseeing the trial, granted the defense request when it came out that a police interview had taken place with the defendant outside of the scope agreed upon by her defense attorney at the time, and that the information she gave about her pending case was not turned over to the defense until the trial had started.

Public defender Gregory Elvine-Kreis, who heads the county's Conflict Counsel Office, then filed a motion to dismiss charges against his client.

In his ruling Friday, Watson said the accusation that former Deputy District Attorney Allan Dollison, who resigned earlier this month, knew the content of the interview without disclosing it to the defense was convoluted.

”There's different versions to what exactly was known and when,” he

said. “It's unclear, quite frankly, whether he knew.”
Watson said the non-disclosure was not egregious enough to warrant dismissal. Elvine-Kreis indicated Friday that he would look into appealing the judge's denial to dismiss charges.

At the court hearing before Watson this week, Elvine-Kreis said a dismissal of the case would be the only way to send a message to the Eureka Police Department and District Attorney's Office about protecting defendants' rights.

”When this type of interference with attorney-client privilege happens, you're the last piece of accountability,” Elvine-Kreis said. “This court has to let the district attorney's office know that this is not negligence.”

Deputy District Attorney Zachary Curtis said dismissing the case was a drastic measure.

”There are other remedies, other means of holding prosecutors and police accountable,” he said, adding that it is not “this court's task to punish police and prosecutors.”

In opposing the motion to dismiss, Curtis said Dollison had no reason not to disclose that he knew about the police interview.

”It just boggles the mind to think that the prosecutor would deliberately hide this information,” he said. “It just escaped Mr. Dollison entirely.”

Curtis said it amounted to “facts lost to an extremely busy prosecutor in an overloaded office.”

Elvine-Kreis said understaffing wasn't a justification for the violation of a defendant's rights.

”Part of the reason this happens is they are overwhelmed,” he said. “If they are overwhelmed, they need to hire.”

Rory Little, a former prosecutor and law professor at University of California Hastings, said a heavy workload can lead to mistakes.

”People forget that lawyers are human beings, and it's not easy to handle a caseload,” he said. “At the same time, the rules are pretty clear.”

Dollison took the stand on Wednesday, answering questions from Elvine-Kreis and Deputy District Attorney Zachary Curtis about when he was aware that an EPD detective had interviewed the defendant in February.

Dollison said he became aware of the interview in July, but was not aware of the content of the interview -- which Elvine-Kreis called a confession -- until Dec. 10, after the trial had begun.

Elvine-Kreis said that Dollison knew about the interview in March, when he offered a reduced plea deal to the defendant. Dollison said he offered the deal without knowing the content of the defendant's statement, but Elvine-Kreis took exception, arguing that it was “ludicrous” that Dollison reduced an offer without knowing the content of the interview.

Watson said in his ruling that it was “peculiar” that EPD never provided the interview to the district attorney's office, and that Dollison did not request or receive the contents of the interview before the trial began.

”None of that is flushed out,” Watson said. “It doesn't occur, and that's odd.”

It remains unclear if there will be any disciplinary action regarding Dollison's non-disclosure of the interview to the defense. The State Bar could pursue the matter if it received a referral from the district attorney's office, Elvine-Kreis or a judge.

In a column submitted to the Times-Standard, Dollison said that resigning was the best decision “for my career and ultimately my family.”

Little said the State Bar has indicated that it's taking prosecutorial misconduct more seriously.

”There's increasing concern about the way prosecutors conduct their business these days,” he said.

Little said prosecutors are typically under more scrutiny by the media and the public.

”That's not necessarily wrong,” Little said, but can mean that they get less margin for error than defense attorneys.

”You can't draw any inferences from resignation,” he said. “I've seen prosecutors resign when they've done nothing wrong -- they're tired of being a punching bag.”

With dozens of supporters standing behind him, Humboldt County District Attorney Paul Gallegos announced his campaign seeking re-election Friday, pledging to continue making the difficult decisions and serving all the county's residents.

”We have never backed down, and we never will, because while a ship in harbor is safe, that's not what ships are for,” Gallegos said at the event Friday, held at his campaign headquarters at 321 Third St. in Eureka.

Gallegos, who was first elected to the office in 2002, is seeking his third term as Humboldt County's top law enforcement official, facing challenges from Allison Jackson, Paul Hagen and Kathleen Bryson, all of whom have announced their intention to run for the office.

Humboldt County District Attorney's Office Investigator Wayne Cox spoke at the event, saying he was hired on with the office in 2007, and was refreshed by Gallegos' can-do attitude and the open minded way he approached the job.

”As a tight-knit team, the District Attorney's Office has accomplished great things, including the cases against Paul Jasnosz, Andy Belant, Dave Gundersen and Steve Hash, some of the most vicious and heartless predators in our community,” Cox said.

“Because of Paul's direction and leadership, they are now being held accountable for their actions, as are countless other felons that have been convicted during Paul's tenure as district attorney.”

Former California Assemblywoman Patty Berg introduced Gallegos at the event, calling him a dear friend, and said he has been effective and courageous in bringing his office into the 21st century.

”Paul believes that it's his job to stand up for all the people of Humboldt County, and I so appreciate that,” Berg said, adding that when Gundersen, the former Blue Lake police chief, was arrested, Paul took it upon himself to try the case. “By appearing in the courtroom, Paul leads his office from the front, not from behind. He leads by example.”

Local defense attorney Peter Martin made similar comments.

”I'm impressed that he does handle high-profile cases himself -- there's always some political risk in that,” Martin said, adding that he wasn't always a Gallegos fan.

Having spent 10 years as a deputy district attorney working under Gallegos predecessor, Terry Farmer, Martin said he was “obviously not a supporter” early in Gallegos' tenure in the DA's office. But, over time, Martin said he worked with Gallegos on several cases and walked away impressed.

Keith Taylor, of the Center for Indian Law & Economic Justice, said he's supporting Gallegos partly because of his work with local tribes. For the last two years, Taylor said Gallegos has been holding monthly roundtable discussions with tribal leaders to discuss law and order and sovereignty issues.

After taking the podium at the event, Gallegos spent the first half of his remarks thanking his staff.

”They are truly a dedicated group of hardworking people who every day come early and leave late,” he said. “It is a pleasure to work with them.”

Then, Gallegos lauded his accomplishments in re-inventing the DA's office into a modern-day law office that represents all the people of Humboldt County. Asking the people of Humboldt County to again check his name on the ballot, Gallegos said he will continue working to rid the county of what Mahatma Gandhi deemed the seven deadly sins: “Wealth without work, pleasure without conscience, knowledge without character, commerce without morality, science without humanity, religion without sacrifice, and politics without principle.”

That there are actually people who would publicly support Gallegos after all of the horrible lapses in poor judgement prosecuting, no, persecuting people for all the wrong reasons wasting valuable public resources over the his last term, well, that says an awfull lot about Humboldt County.

Maybe you'll pleas bargain the 26 year old soccer coach.

Gallegos couldn't even win the Rex Shin murder trial. They were neck deep out there in a marijuana grow, doing meth, morphine, and cheating on each other's wives. The DA made a immunity deal to find and dig up the decomposed body of Rex Shin. A Sheriff even chased down and caught the suspect Sequoia on foot in Eureka and found the .357 magnum revolver murder weapon that he used to shoot Shin in the head with, hidden on him. Still no conviction. For a DA that gets off on digging up the dirt and setting up murder trials, he sure has a hard time winning them.

You lost me at tea bagger. Most people in Humboldt County that are educated professionals are actually quite open minded. You are either new or of a naive age where you have no concept of how the DA's office was managed/run/led by Terry Farmer. He had the best and the brightest serving a prosecuters under him.

Gallegos does not have one competent criminal prosecutor amongst his rank and file.

There a reason why and if you can't see or undertand the why then it's obvious why you are a Gallegos supporter.

He has had more than enough time to prove he can do the job. Instead he has proven to be a horrible manager. Cases are back logged, statuing out because no one is filing them in a timely manner, plea bargained out just to get a conviction. There is no mentoring the junior district attorneys who try hard, but do not know what they are doing. Its time for a change before more victims get victimized again. There has been many high profile cases bungled, tax payer dollars wasted.

If the Gunderson case is an example of Gallegos' ability as a leader, this county is in great trouble. Gallegos mishandled this case from the start. He let Darcie Seal-Gunderson walk when she committed more serious crimes than her husband. Why did he not prosecute her for her crimes when she reneged on the "Plea Bargain" she was given for testifying against her husband for trumped up charges she accused him of? When she admitted on the stand that she was and had committed perjury why wasn't she then charged for her crimes since she broke the "plea Bargain"? She played Gallegos and the DA Office like a pro. The only victim in that whole case was the tax payers who had to flip the bill for a expensive political ploy...So Mr. Cox is this the "direction and leadership" your boss offers? This is only a few problems with the Gunderson case and only one of many questionable decisions that Gallegos has made regarding cases, not for the people, but for Gallegos' political career.

I am a progressive. I would like to see marijuana legalized and taxed. I believe in universal health care. And I think that the Gallegos DA's office is a shambles, a place with a horrible turnover rate, a lack of organization, an unwillingness to play hardball even when they hold all the cards. To me this isn't about politics, it's about the ability to prosecute criminals appropriately, and Gallegos has proved over the course of eight years that he's not very good at it. We deserve better.

Also consider how Paul Hagen lost his position as the three-county environmental prosecutor. In the 2006 election the Humboldt Dem party endorsed Gallegos without having open discussion on the topic. Hagen, active in the party, objected - not to the Gallegos endorsement, but to the lack of discussion. Shortly thereafter he was fired by Gallegos, and there is now a non-disclosure agreement on the matter, leading me to suspect that Hagen received some sort of compensation for being wrogngly let go. This is how Gallegos operates.

I'm leaning towards Alison Jackson at this point, but none of the candidates thrill me. Gallegos got my vote in 2002, and has betrayed that confidence.

I think you should thank the people of California and the Supreme Court for upholding the Compassionate Use Act (215). All any DA can do is uphold the laws that are written, they are not write laws. If you want Humboldt County to be less pot friendly take it up with you City, County, and State representatives. Or you could go and tell the Supreme Court that they were wrong when it ruled that all limits on cultivation were unlawful. Stop blaming Gallegos for every little thing that you see is wrong with Humboldt County. JTC, have you ever worked in the D.A's office? Know anyone who does? If not, then you are sadly misinformed. If so, you're being misled. Gallegos is a master of smoke and mirrors. He and his camp skew statistics and engage in vagueries the general public would never be able to know enough about to dispute. They count on the voting public being a bunch of rubes who will just swallow what they say without question. Now Gallegos has some of his staff involved who, by the way, are groveling at his feet. Why are they paying political homage? Because they want to be next in line if Chief Investigator Mike Hislop is elected Sheriff.

As for all the meth houses, Gallegos didn't have the slightest thing to do with that. You can thank our men and women in law enforcement for taking care of that problem. The position of D.A. is that of an ADMINISTRATOR, not a trial lawyer. You don't see other department heads doing the work their rank-and-file is paid to do. That's because those department heads are busy managing their offices. That's what Paul should be doing but he's more interested in grand-standing.
Vote for Allison Jackson. At least then the Humboldt County D.A's office won't be owned by the local defense bar.

All law enforcement are struggling with budgets and it seems that placing more effort into preventive programs with the involvement of the DA's office would strengthen programs needed for various communities.

I just moved to a new neighborhood was was warned by the Postal Worker that he would not leave packages I received at my doorstep. It stating that the neighborhood was not the greatest to live in and a new mailbox system is needed to protect deliveries of medicines and other supplies. This says to me that there is a need for a better cooperation between law enforcement from the local police to the DA and the neighbors living in the area.

Well, Gallegoes, you have any thoughts about my suggestion?

Why would he even mention the Dave Gundersen/Darcie Seal case?! Darcie Seal played Gallegos big time to keep herself from going to prison. She admitted to trading guns from the Blue Lake evidence locker to her ex-brother-in-law Carl Patton for drugs. He used one of those guns in an attempted murder of his girlfriend and got a plea bargain for giving up Darcie. Darcie also admitted to having her minor son buy drugs for her. She admitted to trading grow equipment from the evidence locker to her ex-brother-in-law to set up a grow in one of her rentals. Darcie admitted to taking drugs. The whole rape thing was just a ploy to keep her out of prison. She had been a member of the rape panel in Eureka that consists of local female cops from different departments. She did research on "cop domestic violence" before crying rape.(computer forensics showed this) Plus....Gundersen wasn't the first man she's accused of raping her. Darcie loves "role playing". Obviously Gallegos was too excited about getting another chance to bring down yet another police chief since he'd already blown getting the EPD Chief to really look into Darcie's past. He told her that if she lied the plea deal was off but when she admitted to perjury he never charged her with anything. Yes, Darcie is really proud of the fact that she was able to pull this off with no charges filed against her.

And as for the Huntszinger case? Dave and Darcie lied to poor Nancy for years while all the evidence to solve the case sat in the lunchroom untouched.

Gallegos seems to only want to handle high profile cases that he thinks will bring him fame. So far all I've seen him do is plea bargain his cases down to nothing. SOFT on crime describes him alright.

It'll help them understand rather than feel unimportant and used.

You can work with local law enforcement and still maintain control over them if you are respectful of the public and not afraid to explain your decisions.

And as you pointed out, it is a problem that Gallegos needs to look at for changing his policies. I will vote for some one besides Gallegos just looking for change - especially change between law enforceent and the DA's office.

Everyone needs to tell their friends to vote so we get this guy out of office before he does more damage. We will live with his reign for years. A Humboldt County Superior Court judge upheld the plea deals reached in the case of Jason Whitmill and Anthony Flores on Friday, sentencing them - 14 years eight months and three years in prison respectively - for their roles in the 2008 car crash that took the life of a 9year-old girl.

Whitmill, 32, and Flores, 19, were racing at speeds of over 100 mph along State Route 299 on Oct. 6, 2008, when Whitmill's vehicle clipped a sport utility vehicle, causing it to veer from the road, down an embankment and into a utility pole.

Nicole Lynn Quigley, a fourth-grader at Dow's Prairie Elementary School, was killed in the wreck and her mother, Debra Quigley, suffered major injuries. Nicole's twin sister, Ashley, and a family friend were also in the car, but were uninjured in the crash.

Before sentencing the defendants, Humboldt County Superior Court Judge Dale Reinholtsen and a packed courtroom listened to emotional statements from Nicole's friends and family, who talked about the bright life that was lost in the tragic accident.
Addressing the court and the defendants, Nicole's father Ken Quigley read a statement from Ashley.

"My sister was my best friend - we did everything together," he read as sobs and the sound of choked-back tears emanated from throughout the courtroom. "You don't know how much I miss her. ... You took my best friend away from me. She was only 9 years old. I will miss her every second of my life. My sister was the best sister in the world, and I will never forget her."

Reading from a prepared statement of his own, Ken Quigley said that Tuesday Aug. 17, 1999, the day his twin daughters were born, was the happiest of his life. He said his joy only grew as he watched Nicole blossom into an intelligent and beautiful young girl who would come to work with him and tell him that, one day, she would take over the family business.

Flores and Whitmill, Ken Quigley said, took all that away.

"The thought of this makes me sick to my stomach," he said. " The courts cannot impose on you the punishment you deserve."

Some speakers expressed frustration at the plea deals reached by the defendants. Whitmill had faced murder charges for his role in the crash, but wound up pleading guilty to gross vehicular manslaughter while intoxicated, and to driving under the influence causing great bodily injury, as well as to a special allegation of having served three prison terms.

According to Reinholtsen, the deal leaves Whitmill with two strikes on his record, meaning if he is convicted of another strikable offense he would automatically face a prison sentence of 25 years to life.

Flores pleaded guilty to gross vehicular manslaughter and hit-and-run for leaving the scene of the accident, spawning a days-long manhunt.

Deputy District Attorney Maggie Fleming told the court that defense appeals regarding Whitmill's blood being drawn without his consent the day of the accident - while it was still unknown who the driver of the vehicle was - played into her office's decision to accept the plea deals rather than prosecute the case.

Reinholtsen ruled in November that Whitmill's blood was legally drawn. The defense appealed the decision unsuccessfully to an appellate court, then took the matter to the California Supreme Court, which declined to hear the matter.

Fleming said her office was concerned the matter would make any possible conviction in the case susceptible to appeals. As a part of their plea deals, both Whitmill and Flores have agreed to waive all rights to appeal.

After Friday's hearing, Ken Quigley expressed frustration at the way the case was handled by District Attorney Paul Gallegos. He charged that Gallegos was unprepared for court appearances, twice dropped it in the lap of unprepared deputy district attorneys and generally handled it in an unprofessional manner.

"Had this case been handled from the beginning by someone with the experience of Maggie Fleming, it would have had a much different outcome," Ken Quigley said. "I'm not here to knock people, but I'm very disappointed with the way Mr. Gallegos handled this case. Next year can't come soon enough. It is an election year, isn't it?"

Gallegos told the TimesStandard in a previous interview that the case was handled properly from start to finish.
In addressing the court, Nicole's uncle, Mike Quigley, said complaining about the sentence won't do any good. Instead, he vented anger at the defendants and a criminal justice system that released Whitmill from custody less than two weeks before the crash.

"In a just world, none of us would be here because he wouldn't have been on the streets," he said, before turning his attention to both defendants. "You killed a 9year-old girl and neither one of you are man enough to stand up and take responsibility for it. God bless my beautiful niece and her mom and dad and sister, and God damn both of you."

Mike Quigley's comments drew a round of applause from the packed courtroom, which was awash in pink as many members of the Quigley family and their friends were clad in Nicole's favorite color. So many people attended Friday's sentencing that an overflow room was set up, where those who couldn't fit in Reinholtsen's courtroom watched the proceedings via a video feed.

As Nicole's friends and family addressed the court, the defendants sat in the jury box with their lawyers. A stoic Flores sat, clad in an orange jumpsuit, staring at speakers as they addressed the court. Throughout most of the proceedings, Whitmill sat with his eyes cast toward his feet, showing little emotion. Then, Dan Johnson, Nicole's soccer coach, addressed the defendants.

"If you want to take responsibility for your actions, you might start by looking at speakers when they are talking to you," he said, sending Whitmill's eyes darting up to his.

When Sandy Henry addressed the court, she explained that she taught Nicole in her last year at Dow's Prairie before retiring, adding that Nicole was an integral part of her favorite class in 30 years of teaching. Nicole, Henry said, was going to do great things in life. Hearing this, Whitmill began to weep, wiping tears on the shoulder of his orange jumpsuit and again casting his eyes to his feet.

" Three years from now Nicole would have been getting ready to go to high school. Fourteen years from now she would have been graduating from college, getting ready to start a career," Henry said. "I'm at a loss to see equity in this judgment."
Glenn Brown, Whitmill's attorney, also addressed the court, reading a letter from his client.

"On Oct. 6, 2008, I caused the death of your daughter by driving drunk and racing another vehicle," Brown read. "I feel so terribly sorry for the pain I caused your family."

Flores provided no statement to the court.

In handing down the sentences of 14 years and eight months for Whitmill and three years for Flores, Reinholtsen echoed the sentiments of many. " There's no sentence the court can impose that can right this wrong. I recognize that," he said, adding that he hopes the publicity the case drew and the Quigley family's sharing of their pain with the community might make a difference. "Perhaps that will cause someone we don't know, and will never know, to drive in a more safe manner." Many in court Friday talked about the joy that Nicole Lynn Quigley brought to their lives. They spoke of her love for dance, her dedication to her studies and her ability to draw a smile - and the best - from people.

"I know Nicole loved every moment of her life with every ounce of her being," Henry said. "My challenge now is to honor her by finding joy in every moment of my life."

On Monday, Aug. 3, the friends and family of Nicole Lynn Quigley once again attended court for what was supposed to be a pre-trial hearing for Jason Whitmill and Anthony Flores and once again Whitmill's attorney, Glen Brown, paid for by you and me, the taxpayer, succeeded in getting the trial date moved out to the end of September. One of Glen Brown's excuses was that he had more important trials scheduled at the same time as this one. Since I am not allowed to speak during court, my question to Glen Brown is, “More important to whom?” After two judges have reviewed the charges against Whitmill and concurred that second-degree murder will stand against Whitmill for his reckless regard for human life, Mr. Brown has now sent the case off to the California Appellate Court in another one of his tactics to delay the inevitable. How this man sleeps at night is beyond me. In the meantime I will be watching very closely for what trials come up around Sept. 8 that are so important that we need to delay some closure to my family and friends and Whitmill's and Flores' trip to the big house.
